What Is Considered Child Pornography in Missouri?

Under federal law, child pornography is defined as any visual depiction of sexually explicit conduct involving a minor (anyone under 18 years old). This includes pictures, movies, videos, and even computer-generated images. In order for an image to be considered child porn, it must be proven that the person depicted in the image is a minor, and it must be proven that the image is sexually explicit.

Under Missouri law, child pornography is any type of sexually explicit material that depicts a child under the age of 18 in a sexual manner. This includes any photographs, movies, video recordings, or pictures that depict a child in a sexual manner. It does not matter if the child consented to being photographed or recorded, or if the child is an adult now.

What Are the Penalties for Child Pornography in Missouri?

The penalties for child pornography in Missouri depend on the type of offense and the type of material involved. For example, possession of child pornography is a class D felony, and the penalties include up to four years in prison and/or a fine of up to $10,000. If you are convicted of possession of child pornography that includes a depiction of a violent sexual act against a child, the offense becomes a class B felony, and the penalties include up to 20 years in prison and/or a fine of up to $20,000.

Distribution of child pornography is a class B felony, and the penalties include up to 15 years in prison and/or a fine of up to $20,000. If you are convicted of distribution of child pornography that includes a depiction of a violent sexual act against a child, the offense becomes a class A felony, and the penalties include up to 30 years in prison and/or a fine of up to $50,000.

How Does a Prosecutor Prove that I Possessed Child Pornography?

In order for you to be convicted of possessing child pornography, the prosecution must prove that you knowingly possessed the material. For example, if you were arrested for driving with a DVD in your car that turned out to be child pornography, it does not necessarily mean that you knowingly possessed it. It must be proven that you knew what was on the DVD and that you intended to watch it. If you were arrested for possessing a computer that contained child pornography, it is assumed that you knowingly possessed the images.

How Can I Fight Child Pornography Charges?
