What a Missouri Expungement Actually Does

Under RSMo 610.140, a granted expungement order restores you to the legal status you held before the arrest, plea, or conviction, as if it never occurred. The record is closed to the public and generally won’t appear on background checks run by employers or landlords. In most situations, you can lawfully answer that you haven’t been arrested or convicted of the expunged offense.

That said, expungement isn’t a complete erasure in every context. Certain professional licenses, law enforcement positions, and other regulated roles may still require disclosure even after an order is granted. We can walk you through those nuances before you petition so there are no surprises.

Missouri Waiting Periods & Lifetime Limits

Missouri law sets minimum waiting periods before a petition can be filed, measured from the date you completed your full disposition, including sentence, probation, parole, fines, and restitution. General rules under RSMo 610.140 include:

  • Felony conviction: At least three years after completing the authorized disposition
  • Misdemeanor, municipal violation, or infraction: At least one year after completing the authorized disposition
  • Arrest without charges filed: No earlier than eighteen months after the arrest date, provided no charges were filed and no subsequent conviction occurred

During the waiting period, you must not have been found guilty of any other misdemeanor or felony, excluding routine traffic violations. Missouri also caps lifetime expungements at two felony offenses and three misdemeanor or ordinance offenses. Related offenses arising from the same course of conduct can count as a single entry toward those caps. These are general statutory rules, and actual eligibility depends on the specifics of your record.

Offenses Missouri Permanently Excludes from Expungement

Not every conviction is eligible. The following categories are permanently barred under RSMo 610.140, regardless of how much time has passed:

Ineligibility is tied to the specific offense, not when it happened. If your offense falls into an excluded category, no amount of time changes that. During your free consultation, we review your record directly and give you a straight answer on where you stand.

How the Missouri Expungement Petition Process Works

A petition for expungement is filed in the court where the arrest, charge, or conviction was originally entered. For Greene County cases, that is the 31st Judicial Circuit Court in Springfield. The petition must identify each offense and name every agency that holds related records. Any agency not named in the final order isn’t bound by it, which makes thorough preparation at the filing stage essential.

The 30-Day Objection Window & Prosecutorial Strategy

After the petition is filed, the prosecuting or circuit attorney has 30 days to file an objection. Our founding attorneys led prosecution teams, including a Major Crimes unit, so we understand how a prosecutor’s office evaluates these petitions and what objections are most likely to surface. We use that knowledge to strengthen the petition before it’s filed rather than react after an objection arrives.

Rebuttable Presumption & Court Timeline

Missouri statute creates a rebuttable presumption in favor of expungement when the petitioner establishes they aren’t a threat to public safety and that expungement serves the interests of justice, placing the burden on the prosecutor to push back. The court generally has six months from the filing date to issue a ruling, though actual timing varies.
